1. Overview

Near.Biz (“we,” “us,” or “our”) provides an online platform connecting users—both service providers (“Pros”) and customers (“Customers”)—for booking and delivering service packages, as well as companies (“Vendors”) offering verified products and services.

By using Near.Biz, you agree to these Terms of Service (“TOS”). We are committed to maintaining a secure, transparent, and reliable marketplace built on Trust & Safety. Please refer to our dedicated Trust & Safety Policy for further details.

2. Platform Services

Booking & Scheduling

We provide a secure booking engine that enables Pros and Vendors to manage their profiles, pricing, and project data, while Customers can browse, request, and confirm service or product orders in real time.

Company Profiles, Product Listings, and Platform Content Ownership

Authorized companies may create and maintain company profiles and upload service listings, including but not limited to descriptions, specifications, pricing, images, videos, and other related content (“Listings”).

By submitting or uploading any Listings or participating in the performance of services through the Near.Biz platform, you acknowledge and agree that:

1. Platform Ownership of Marketplace Content
   All service-related content generated, collected, or displayed on the platform—including service descriptions, pricing, images, media, job performance data, completion records, customer communications, reviews, ratings, feedback, and transaction metadata (collectively, “Marketplace Content”)—is and shall remain the exclusive property of Near.Biz.

2. License to Use Contributed Materials
   To the extent that any Listings or materials are originally provided by you, you grant Near.Biz a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from such materials for the operation, promotion, improvement, and protection of the platform.

3. Content Modification and Removal Rights
   Near.Biz reserves the unrestricted right, at its sole discretion, to edit, reformat, suspend, remove, or replace any Listings or Marketplace Content at any time to:

   • Protect customer trust

   • Enforce fair marketplace practices

   • Maintain data accuracy and consistency

   • Comply with legal, regulatory, or platform requirements

   • Prevent fraud, misrepresentation, or misuse

4. Survival After Account Termination
   Ownership and license rights granted to Near.Biz with respect to Marketplace Content shall survive termination, suspension, or closure of any company account.

5. No Ownership Interest Granted
   Nothing in this Agreement grants any company ownership, control, or proprietary interest in platform-generated Marketplace Content, including content derived from service performance, customer interactions, or historical transaction data.

Service Descriptions

We strive to ensure all descriptions, images, pricing, and availability are accurate. However, all data submitted by companies or users is subject to review and modification by Near.Biz for consistency, reliability, and user safety.

Errors, inaccuracies, or misrepresentations will be corrected promptly.

Customer Support

We aim to respond courteously and efficiently to all inquiries, complaints, or disputes.

Content & Resources

We provide expert-reviewed guides, industry insights, and educational materials to help both Pros and Customers make informed decisions.

Trust & Safety Assurances

• Pre-Screened Service Professionals: Verified individuals or companies are informed of the service scope and address before arrival.

• Verified Orders: Orders are screened for authenticity, address, and payment security.

• Transparent Pricing: The price shown at checkout is the final price unless a written authorization is provided. No hidden or misleading fees are permitted.

3. User Accounts & Data Privacy

Data Collection

We collect essential information such as names, contact details, addresses, and payment data (processed via third-party providers). We do not store full payment information.

Data Use

Your data is used strictly to fulfill bookings, manage transactions, and improve your Near.Biz experience.

Data Sharing

Information may be shared with verified Pros, Vendors, and partners solely for order fulfillment or support purposes.

Data Accuracy and Oversight

All uploaded content (including company data and pricing) remains subject to Near.Biz verification and moderation to ensure safety, reliability, and privacy compliance.

Your Rights

You may request access, correction, or deletion of your personal or company data under applicable U.S. data protection guidelines.

4. Payments & Fees

Advance Payment

A payment guarantee (including applicable taxes) is required at the time of booking. Any price adjustments require written authorization.

Payment Processor

Payments are securely processed through reputable third-party providers; Near.Biz does not retain complete payment credentials.

5. Security & Third-Party Links

All sensitive data is encrypted via SSL.
We are not responsible for content or practices on third-party websites linked from Near.Biz.

6. Liability & Disclaimers

Platform Role

Near.Biz serves as a technology facilitator between Customers, Pros, and Vendors. We do not control the actual service or product outcomes, and performance remains the responsibility of the provider.

Limitation of Liability

To the maximum extent permitted by law, Near.Biz is not liable for indirect, incidental, or consequential damages arising from service performance, data accuracy, or user content.

7. Content Review & Modification Rights

To preserve marketplace integrity, Near.Biz retains the right to modify, remove, or adjust any listing, pricing, description, or uploaded data if such content:

• Violates our Trust & Safety standards

• Misrepresents the product or service

• Endangers Customer privacy or safety

• Conflicts with applicable regulations or our internal policies

8. Changes to Terms

We may update these Terms at any time. Continued use of the platform implies acceptance of the latest version. Please review this TOS periodically for updates.

9. Agreement

By creating an account, uploading products, or completing a booking, you agree to abide by these Terms. If you disagree, please discontinue using Near.Biz.
